Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of GetSorted, a Making Tax Digital (MTD) bridging software service operated by Oshy Labs Ltd ("we", "us", "our"). By creating an account or using our service, you agree to be bound by these Terms and our Privacy Policy.

2. What GetSorted does

GetSorted is an HMRC-recognised MTD-compatible software product that enables you to:

• Upload income and expense data from spreadsheets
• Map your data to HMRC-required categories
• Submit quarterly updates to HMRC under Making Tax Digital for Income Tax Self Assessment (MTD ITSA)
• View your filing obligations and submission history

3. Your responsibilities

• You are responsible for the accuracy of all data you upload and submit to HMRC via GetSorted.
• GetSorted is a bridging tool, not an accountant or tax adviser. We do not provide tax advice.
• You must ensure your NINO, UTR, and income/expense figures are correct before submitting.
• You are responsible for meeting HMRC deadlines. GetSorted provides reminders but does not guarantee submissions will be accepted.
• You must keep your account credentials secure and notify us immediately if you suspect unauthorised access.

4. HMRC authorisation

To submit data to HMRC on your behalf, you must authorise GetSorted via HMRC's OAuth process. By doing so, you grant us permission to:

• Read your self-assessment obligations from HMRC
• Submit quarterly updates and annual returns on your behalf

You can revoke this authorisation at any time from your Settings page or directly via your HMRC online account.

5. Subscription and payments

GetSorted offers a free tier and paid subscription plans. Paid plans are billed monthly via Stripe. By subscribing, you agree to:

• Pay the subscription fee for your chosen plan
• Automatic monthly renewal unless you cancel before the next billing date
• Stripe's terms of service for payment processing

You can cancel your subscription at any time from Settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.

6. Limitation of liability

To the maximum extent permitted by law:

• GetSorted is provided "as is" without warranty of any kind, express or implied.
• We are not liable for any penalties, interest, or losses arising from incorrect, late, or failed submissions to HMRC.
• We are not liable for any loss arising from HMRC system outages, API changes, or rejection of submissions.
• Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim.

7. Data and security

We take data security seriously. Details of how we collect, use, and protect your data are set out in our Privacy Policy and Security page. Sensitive data including your NINO and UTR are encrypted at rest using AES-256. HMRC OAuth tokens are stored server-side only and never exposed to your browser.

8. Account termination

You may delete your account at any time from the Settings page. Upon deletion:

• Your HMRC connection will be revoked
• Your personal data will be deleted, subject to legal retention requirements (HMRC mandates 7-year record keeping)
• Audit logs of HMRC submissions will be retained for the legally required period

We reserve the right to suspend or terminate your account if you breach these Terms or use the service for unlawful purposes.

9. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
